These terms and conditions govern your use of Nexxteq services and products. By using our services, you agree to these terms.

1. About Nexxteq

Nexxteq provides smart home and office solutions, including system design, installation, configuration, and software services. The registered office is in Ghent, Belgium. Throughout these terms, "we," "our," and "us" refer to Nexxteq; "you" refers to the customer, partner, or site visitor.

2. Scope of Services

Services include consultation, analysis, and design of intelligent automation systems; delivery and configuration of hardware and software components; and after-sales support, maintenance, and updates as agreed per project. Each project or subscription is governed by its own written proposal or service agreement.

3. Pricing & Payment

All prices stated in euros and exclude VAT unless noted otherwise. Quotes remain valid for 30 days unless stated otherwise. Payment terms specified in each agreement; late payments may incur statutory interest. Hardware remains Nexxteq's property until fully paid.

4. Installation & Third-Party Work

Where installation involves certified partners or subcontractors, Nexxteq ensures coordination and quality control but cannot be held liable for delays or damages caused by third-party works outside their control. Customers agree to provide reasonable site access, power, and connectivity during installation.

5. Software & Updates

Systems use open and proprietary software components including Home Assistant and Nexxteq modules. Updates and improvements are provided where possible; compatibility with third-party devices may change over time. You agree not to modify or redistribute Nexxteq software without written consent.

6. Warranties & Liability

Hardware supplied by Nexxteq is covered by the manufacturer's warranty. Configuration and software setup are warranted for 12 months after handover. Nexxteq is not liable for indirect, incidental, or consequential losses arising from system failure, misuse, or third-party integration issues. Total liability is limited to project value or annual subscription fee, whichever is lower.

7. Support & Subscriptions

Support and monitoring services are provided under active subscriptions only. If subscriptions lapse, support reverts to time-based hourly rates. We may adjust subscription pricing with 30 days' notice.

8. Data & Privacy

Information collected is necessary for delivery, support, and system improvement. Personal data is processed per Nexxteq Privacy Policy and EU GDPR. You retain ownership of your usage data; Nexxteq may use anonymized data to improve system performance.

9. Intellectual Property

All designs, configurations, and software code developed by Nexxteq remain our intellectual property unless otherwise agreed in writing. Customers receive a non-exclusive license for intended system use.

10. Termination

Either party may terminate in writing if the other fails material obligations without remedy within 30 days of notice. Outstanding fees become immediately due upon termination; active services are discontinued.

11. Governing Law & Jurisdiction

Terms governed by Belgian law. Disputes settled before competent courts of Belgium unless otherwise agreed.
